Many attorneys in Minnesota are making Smart Start an important part of their defense strategies. If you are in need of legal advice, we can recommend an attorney who can help you. The attorneys that we recommend are not those that are more concerned with putting money in their pockets. The attorneys we refer you to care about their clients, which means the attorney you choose will take care of you.
Smart Start gives your attorney a tool to use when it comes to fighting the suspension of your driving privileges. When you have been charged with DUI or DWI, a conviction can cause you to lose your driving privileges. This can be difficult when you have a job to do, kids to raise, and errands to run. That is why Smart Start exists. It exists as a tool that the court can turn to as a penalty that still allows you to have your freedom. You cannot operate your motor vehicle until you have breathed into the device and showed it that you have not consumed alcohol.
Contacting An Attorney
We do have a number of attorneys we can refer you to who will take care of your case and work hard toward the Smart Start solution rather than settle for license suspension. The implementation makes for a great argument in court if conviction cannot be avoided. It is an attorney’s goal to work toward the best possible outcome in the case, whether that is to have the case completely dismissed or have the charges reduced. Smart Start reduces the impact of the penalties in a conviction. This is why it is very important to have an attorney defend you in court rather than settle with the charges. You don’t have to go about it alone and you don’t have to plead guilty.
Source Code Issues
In the past, there have been issues with the source codes in devices such as the Intoxilyzer 8000 when field sobriety tests have been performed and this has resulted in cases being dismissed or charges reduced. Even if a client does not escape conviction, it can be argued that ignition interlock would be a good alternative to license suspension. It may also be possible to reduce the license suspension period with Smart Start.
There are also those who had source code issues seeing reinstatement of their drivers’ licenses, but it still may be required for an ignition interlock device to be installed to ensure that there are no other attempts to drive under the influence of alcohol.
